(“Watch Gang”, “we” or “us”), developer and the operator of watchgang.com and watchtext.com, which includes an online retail store (collectively the “Sites”), is committed to preserving the privacy of those who visit the Sites. This document will outline how we gather and utilize various sources of information obtained during your visit to the Sites. INFORMATION COLLECTED
Personal Information. If you create an account on the Sites, subscribe on the Sites to become a Member, as defined in the Terms of Use, and/or place an order through watchgang.com or watchtext.com, whether a one-time purchase or the purchasing of a recurring Membership Plan, as defined in the Terms of Use, we will ask you for your name, e-mail address, shipping address, telephone number and credit card information or certain other personally identifiable information about yourself ("Personal Information"). We use this information to process and fulfill your order and to notify you of your order status. All archived credit card information is maintained in a secure and safe environment. Telephone numbers and e-mail addresses are used to contact you regarding your order. In addition, when you respond to a contest, survey, questionnaire, sweepstakes or other promotional feature, we may ask you for your name, address and email address or other Personal Information. We do not collect any Personal Information about you unless it is voluntarily provided by you. Watch Gang will never sell, rent or share your Personal Information, with any third parties for marketing purposes without your express permission.
Non-Personally Identifiable Information. We may also collect non-personally identifiable information, such as IP host address, pages viewed, browser type, duration and frequency of visits, and other data, and may aggregate any information collected in a manner which does not identify any individual ("Aggregate Information"). Aggregate Information and Personal Information obtained in connection with the Sites may be intermingled with and used by us in conjunction with information obtained through sources other than the Sites, including both offline and online sources.
HOW WE USE YOUR INFORMATION
Disclosure. We will not share or disclose your information to anyone except as described in this Privacy Policy.
Publication of Winners. A Member of Watch Gang who wins a Grand Prize in the WATCH GANG™ ROLEX® MEMBER GIVEAWAY, WATCH GANG™ TAG HEUER® MEMBER GIVEAWAY, or any other prize from Watch Gang, pursuant to the Official Rules and Terms of Use, which are incorporated herein by reference, is subject to public acknowledgement of receipt such prize or Grand Prize. You agree that if you win any prize or a Grand Prize, Watch Gang may publicly tag you in posts on social media applications, including, but not limited to, Twitter, Facebook and Instagram, whereby Watch Gang announces you, personally and by name, as the winner of the prize or Grand Prize. Upon receipt of the prize or Grand Prize, you agree to post a photo of the package and its' contents to Facebook and/or Instagram and tag Watch Gang.
ENHANCED AND PERSONALIZED SHOPPING EXPERIENCE
We use Personal Information in order to give you a more enjoyable convenient shopping experience and to help us identify and/or provide information, products or services that may be of interest to you. We use your Personal Information to support and enhance your use of the Sites, and its features, including without limitation: fulfilling your order; providing customer service; tracking email invitations you send; and otherwise supporting your use of the Sites. We may also track your past purchases to provide you with a personalized profile of your shopping history. Unless you specifically consent to the disclosure of your Personal Information, only we, our affiliates, technical consultants, third party auditors, payment processors, delivery services, warehousing services, and other third parties who develop, maintain, service, or otherwise operate the Sites (collectively, “Affiliates”), shall have access to your Personal Information. LAW ENFORCEMENT AND INVESTIGATIONS
Watch Gang reserves the right to and may disclose Personal Information about you in response to (a) requests from local, state or federal law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Sites’ Term of Use, rules or policies, or the rights of third parties or to investigate any suspected conduct which is alleged to be improper.
CHANGE OF CONTROL
We reserve the right to transfer your Personal Information and other information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale or other change in control. In such a circumstance the transferee would be bound by the terms of this Privacy Policy.
SWEEPSTAKES
If you register to become a Member with Watch Gang, make a purchase on watchtext.com, or otherwise submit your email address to be added to a mailing list or Sweepstakes or other promotion, we will use the email address for the sole purpose of sending you announcements, special offers from Watch Gang and its promotional partners. Each email we send will contain information on how to unsubscribe from our mailing list. You can also unsubscribe by sending an email to hello@watchgang.com.
REFERRALS
If you elect to use our referral services for informing a friend about our Sites we ask you for the friend's name and email address. Watch Gang will automatically send the friend an initial email inviting them to visit or transact with the Sites. Watch Gang may also send additional emails reminding your friend that you referred them. Additionally, you may send additional "Nudges" to your friend to remind them to subscribe at the Sites. Watch Gang stores this information for the sole purpose of sending these referral emails and tracking the success of our referral program. Watch Gang will not otherwise use, sell, or distribute such email addresses for any other person without consent of the friend that owns the email address. Such friend may contact Watch Gang at hello@watchgang.com to request the removal of this information from our database and to stop receiving Nudges.
USE OF COOKIES
Our Sites may pass a "cookie" (a string of information that is sent by a web site to be resident on your system's hard drive, and/or temporarily in your computer's memory blocks). The purpose of a cookie is to tell the web server that you have returned to a particular page. The Sites may use cookies in on-line catalogs to keep track of your status and contents of your shopping cart, the sites may use cookies to determine when purchases are not complete and send communication (email or sms) reminders. Cookies are also used to retain customer information which allow you access to password-protected areas of the Sites. You may set your browser to decline cookies. If you do so, however, you may not be able to fully experience some interactive features of the Sites.
PIXEL TAGS OR BEACONS
In addition to cookies, we also collect Aggregate Information through the use of "tracking pixels," also known as "beacons." A tracking pixel is a transparent graphic image (usually 1 pixel x 1 pixel) that is placed on a web page and, in combination with a cookie, allows for the collection of information regarding the use of the web page that contains the tracking pixel. We use tracking pixels to tell when an advertisement has been clicked on or otherwise interacted with, and use that information to judge which advertisements are more appealing to users. In some cases, we use third party service providers to help us collect and analyze this information. HOW WE PROTECT YOUR INFORMATION
We are committed to protecting your Personal Information and Aggregate Information. However, Watch Gang is not liable for disclosures of your Personal Information due to errors in transmission or unauthorized acts of third parties. We have undertaken commercially reasonable efforts to prevent unauthorized Internet access to visitor data retained in our servers, however, due to the inherent open nature of the Internet, Watch Gang cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. Users of the Sites accept all risks associated with any data transmission, including the risk that their Personal Information may be intercepted in transit. The Site encrypts your credit card number and other Personal Information using secure socket layer (SSL) technology to provide for the secure transmission of the information from your computer or device to our servers. Only those Watch Gang employees and third parties who need access to your information in order to perform their duties are allowed such access.
ACCESSING AND UPDATING YOUR PERSONAL INFORMATION AND PREFERENCES
If you register or otherwise create an account on the Sites, or are a Member, as defined in the Terms of Use, you may access and update your registration information, Personal Information, and your preferences to receive email or other communications from us by sending an email to hello@watchgang.com. We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive communications from us for up to ten business days as we process your request. While we make efforts to accommodate requests to restrict our use of your information, we reserve the right to delete all or any portion of customer information if we are not able to reasonably accommodate a requested restriction.
CHILDREN'S PRIVACY AND PARENTAL CONTROLS
These Sites and the App are not intended for persons under the age of 13, and we have no intention of collecting or soliciting Personal Information from persons under the age of 13. If you are not 13 or older, you are not authorized to use the Sites or the App. Parents should be aware that there are parental control tools available online that you can use to prevent your children from submitting information online without parental permission or from accessing material that is harmful to minors. If a child under age 13 has provided us with Personal Information, we will use all reasonable efforts to delete such information from our database.

These "other" domains (websites) are not controlled by Watch Gang. THE GENERAL DATA PROTECTION REGULATION

Your Personal Information is not sold to any third party without your express consent. By filling out a Watch Gang or Watch Text profile, you expressly request to receive information via telephone call, email and text/SMS message (including through the use of an automatic telephone dialing system or artificial/prerecorded voice, SMS or MMS (text) messages, even if your telephone number(s) is/are currently listed on any state, federal or corporate Do Not Call list). Consent is not a requirement to *purchase goods Watch Gang offers*. Standard text message rates and cellular data charges apply. You may opt-out by replying “stop” to any message you receive.
EMAIL COMMUNICATION
By filling out a Watch Gang or Watch Text profile, *including filling out any personal information*, you opt in to Watch Gang occasionally sending you newsletters and emails regarding special offers, promotions, features and/or product updates as well as general marketing emails. We may also communicate with you on behalf of third parties about special offers, promotions, features and/or product updates we think may be of interest to you, or you may have opted-in to receive newsletters or special promotions from one of our trusted third party providers. Right to Delete
You have the right to request that we delete any personal information about you that you have provided to us. Subject to certain limitations, we will delete from our records your requested personal information and direct our service providers to do the same.

Request Verification
Before we can respond to a Request to Know or Request to Delete, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft. Requests to Opt-Out do not require verification.
Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request. If you submit a request not through our webform, we will ask you to provide the same information requested in the webform.
For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.
In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:
- If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
- If the only data we have collected about a consumer is gathered through website cookies (i.e. the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.
Authorized Agent
A California resident's authorized agent may submit a rights request under the CCPA by emailing us at moc.gnaghctaw@ycavirp. Requests submitted by an authorized agent will still require verification of the consumer who is the subject of the request in accordance with the process described above. We will also ask for proof that the consumer who is the subject of the request authorized an agent to submit a privacy request on their behalf by either verifying their own identity with us directly or directly confirming with us that they provided the authorized agent permission to submit the request. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 may also submit proof of statutory power of attorney, which does not require separate consumer verification.

However, we may offer a different price, rate, level, quality, or selection of products or services if your personal data is required in order to provide those products or services and you have exercised your right to opt out, or the offer is related to a voluntary loyalty or rewards program.

Notice of Financial Incentive
Consumers who sign up for our marketing emails/SMS texts receive a 10% discount on their first purchase. To opt in, a consumer must enter their email address/phone number into the form and consent to receive emails in exchange for a discount provided via coupon code. A consumer may unsubscribe from our marketing emails by using the unsubscribe link in the email footer/replying STOP via text at any time. We calculate the value of the offer and financial incentive by using the expense related to the offer.
